Highly Technical Consulting Services for the conduct of the Operational Planning for the Year 2019

RESOLUTION TO HIRE A PLANNING CONSULTANT UNDER NEGOTIATED PROCUREMENT OF HIGHLY TECHNICAL CONSULTANTS
WHEREAS, the Bases Conversion and Development Authority is mandated under Republic Act (RA) 7227, as amended by RA 7917, to accelerate the sound and balanced conversion of the former U.S. military bases and their extensions into alternative and productive uses;
WHEREAS, for 2019, the BCDA Board promulgated its policy direction on updating the BCDA Vision and Mission Statement into a more concise interpretation of its mandate. The result is the succinct mission to Build Great Cities and Strengthen the AFP. While the strategy map was formulated based on the updated charter statement, its objectives still hold true to the ongoing projects of the organization;
WHEREAS, the BCDA Plans and Programs for 2019 are a continuation of what was started in 2017 specifically the BCDA multi-year infrastructure projects under the Build, Build, Build Program. These economically-viable projects support the Board direction to build sustainable cities and are projected to impact the organization’s stakeholders in the long term;
WHEREAS, an Operational Planning Conference will be conducted to:
- Finalize the draft BCDA Vision 2040;
- Finalize the draft BCDA Vision 2020;
- Address the SWOT in terms of action plans implemented;
- Align the 2019 BCDA Plans and Program across the different departments and Task Forces and the 2019 BCDA Scorecard to be committed to the GCG; and
- Update departmental risk registries and treatment plans.
WHEREAS, to ensure that the stated objectives are achieved, there is a need for a highly technical consultant who has the external eye that will provide an objective perspective to the exercises and ensure that the plans are aligned according to the priorities identified during the Board-level strategic planning and at the same time, identify risks attendant to the projects from the perspective of an individual immersed in various industries. This alternative perspective will serve as a check and balance mechanism and ensure objectivity in the preparation of the work plan;
WHEREAS, the Officer-In-Charge of the Office of the Corporate Planning Services, in a memo dated August 8, 2018, endorsed to the Bids and Awards Committee for Consulting Services (BAC-C), the engagement of a Planning Consultant who shall render the following services:
- Familiarization with BCDA and its existing programs, including review of organizational documents and pre-planning with key officers and staff;
- Review the sectoral environment of BCDA;
- Review the Strategy Map and Scorecard;
- Design, structure, manage and facilitate the planning exercises;
- Conduct post-planning activities such as interviews with departments, validation with the different department heads, among others;
- Determine the candidate KRAs and KPIs that will be committed to GCG for operating year 2019; and
- Identify risks attendant to each project for implementation.
WHEREAS, the approved budget for the abovementioned consulting services is Pesos: One Hundred Eighteen Thousand (PhP 118,000.00), inclusive of all applicable taxes and fees;
WHEREAS, Section 48.2 of the Revised IRR of RA 9184 reiterates the general rule that public bidding is the general mode of procurement, the same section allows procuring entities to resort to alternative methods of procurement in highly exceptional cases and subject to the conditions required by RA 9184, its Revised IRR, and applicable guidelines. Among these highly exceptional cases is Negotiated Procurement of Highly Technical Consultants under Section 53.7 of the Revised IRR;
WHEREAS, Section 53.7 of the Revised IRR of RA 9184 allows negotiated procurement as a mode of procuring the services of “individual consultants hired to do work that is (i) highly technical or proprietary; or (ii) primarily confidential or policy determining, where trust and confidence are primary considerations for the hiring of the consultant…” in this case, the main consideration for hiring the consultant is the highly technical work involved;
WHEREAS, the engagement of Mr. Mennen M. Aracid was recommended to render the above-mentioned services having extensive experience in consulting experience in various fields for both the government and private sectors;
WHEREAS, pursuant to Section 53.7 of the Revised IRR of RA 9184, the term of the individual consultant shall, at the most, be on a six-month basis, renewable at the option of the appointing Head of the Procuring Entity (HoPE), but in no case shall exceed the term of the latter;
WHEREAS, pursuant to Section 54.6 of the Revised IRR of RA 9184 highly technical consultants are mandated to register with PhilGEPS and provide a PhilGEPS Registration Number as a condition for award of the contract;
NOW, THEREFORE, we, the members of the BAC-C, hereby RESOLVE, as it is hereby RESOLVED to:
- RECOMMEND the procurement of the services of a Planning Consultant through Negotiated Procurement of Highly Technical Consultants under Section 53.7 of the Revised IRR of RA 9184;
- RECOMMEND the award of contract to Mr. Mennen M. Aracid with a total consultancy fee of Pesos: One Hundred Eighteen Thousand (PhP 118,000.00), inclusive of all applicable taxes and fees for a period of three (3) months from the date indicated in the Notice to Proceed and/or contract, renewable at the option of the appointing HoPE, but in no case shall exceed his term;
- REQUIRE the consultant to register with the PhilGEPS and provide a PhilGEPS Registration Number;
- DIRECT the end user to request for the issuance of the Certificate of Funds Availability (CFA) for the procurement prior to the award of the contract;
- DIRECT the end user to furnish the BAC-C Secretariat original copies of the duly conformed Notice of Award, Notice to Proceed and executed contract; and
- DIRECT the end user to submit to the BAC-C an evaluation of the performance of the Consultant 30 days after the end of the contract
